Participation, Usage, and Privacy Terms

 

 

1. Subject of the Promotion

 

Gurkerl.at GmbH (operated by Gurkerl.at GmbH, Gutheil-Schoder-Gasse 17, 1230 Vienna, hereinafter referred to as "Gurkerl") is conducting a limited-time sweepstakes in cooperation with Les Grands Chais de France NL Deutschland, Moosweg 2–5, 77728 Oppenau (hereinafter referred to as "LGCF") under the name "Entrecôte Enjoyment Sweepstakes" (hereinafter referred to as "Sweepstakes").

The aim of the promotion is to advertise the wine varieties Entrecôte Merlot Cabernet Sauvignon Syrah and Entrecôte Chardonnay as well as the Bag-in-Box Entrecôte Merlot Cabernet Syrah.

 

2. Eligibility

 

Only natural, adult persons (at least 18 years old) with a permanent residence and delivery address in Austria, who are within the current delivery areas of Gurkerl, are eligible to participate.

Only one participation per household and/or delivery address is permitted; multiple participations – regardless of the method – will not be considered and may lead to exclusion.

Employees of Gurkerl, LGCF, and all companies affiliated with them according to §§ 15 ff. AktG, as well as their life partners and relatives of the first and second degree, are excluded from participation.

The sweepstakes is limited to end consumers. Commercial resellers and other legal entities are not eligible to participate.

 

 

3. Promotion Period

 

The sweepstakes begins on 28.07.2025, 00:01 AM (CEST) and ends on 10.08.2025, 11:59 PM (CEST). The recorded order time in the Gurkerl system is decisive for the timeliness of participation.

 

4. Participation Requirements

 

The requirement for qualified participation is the purchase of one of the following promotional products in the Gurkerl online shop or in the Gurkerl app within the promotion period:

• at least six (6) bottles of Entrecôte Merlot Cabernet Sauvignon Syrah or

• at least six (6) bottles of Entrecôte Chardonnay or

• one (1) Bag-in-Box Entrecôte Merlot Cabernet Syrah (3 l).

A qualified purchase generates exactly one participation ticket. Multiple purchases within the promotion period increase the chance of winning accordingly (however, a maximum of one ticket per order, regardless of the number of items ordered).

If the statutory right of withdrawal is exercised after the order is completed, the participation rights for the respective order are retrospectively voided.

Participation is only possible through the online channels mentioned in section 4; submissions by email, post, fax, or phone will not be considered.

 

5. Prizes and Winner Selection

 

A total of 200 (two hundred) prizes will be drawn among all valid participations:

200 × Weber grill sets consisting of grill tongs, grill turner, and grill apron.

The allocation of prizes is done randomly through an independent, automated drawing process. Each eligible customer participates in the drawing with the number of tickets mentioned in section 4.

A cash payout, exchange, transfer to third parties, or self-collection of the prize is excluded. In the event of force majeure or unavailability, Gurkerl reserves the right to replace the prize with an equivalent or higher value substitute prize.

All possible follow-up and additional costs associated with the prize (e.g., connection material, accessories, consumables, operating costs) are borne by the winner, unless expressly otherwise assured in writing.

 

6. Notification and Prize Delivery

 

The prize is randomly drawn among buyers who have purchased one of the above-mentioned products during the prize period. With the handover of the prize to the postal service provider or by dispatch, the risk is transferred to the winner.

 

7. Limitation of Liability

 

Gurkerl is only liable for damages caused intentionally or through gross negligence, any damages resulting from injury to life, body, or health, as well as from the violation of essential contractual obligations (cardinal obligations).

In the case of slightly negligent violation of cardinal obligations, liability is limited to the contractually typical foreseeable damage. Further liability is excluded. Mandatory statutory liability provisions remain unaffected.

 

8. Early Termination / Modification of the Sweepstakes

 

Gurkerl reserves the right to interrupt, extend, or terminate the sweepstakes at any time without prior notice and without stating reasons, if its proper execution cannot be guaranteed for technical (e.g., virus infection, manipulation) or legal reasons (e.g., prohibition by platform operators).

 

9. Data Protection

 

Participation in the sweepstakes requires the provision of personal data (name, address, date of birth, email address, possibly telephone number). The collected data is processed exclusively for the purpose of conducting the sweepstakes and subsequently deleted in accordance with statutory retention periods, unless further consent is given.

Responsible in terms of the GDPR is Gurkerl.at GmbH, Gutheil-Schoder-Gasse 17, 1230 Vienna. Participants have the statutory rights of affected persons (information, correction, deletion, restriction, data portability, and complaint to a supervisory authority). 10. Exclusion in Case of Manipulation

 

Gurkerl reserves the right to exclude participants from participation without stating reasons in case of suspicion of manipulation, automated mass participation, false information, or other violations of these participation conditions.

 

11. Severability Clause

 

If individual provisions of these participation conditions are wholly or partially invalid or become invalid, the validity of the remaining provisions remains unaffected. Instead of the invalid provision, the legally permissible provision that comes closest to the economic purpose of the invalid provision shall be deemed agreed. The same applies to any regulatory gaps.

 

12. Applicable Law and Jurisdiction

 

Only the law of the Republic of Austria applies, excluding the UN Sales Convention. As far as legally permissible, Vienna is agreed as the place of jurisdiction.
