Organizer and Participation Requirements
The New Year's Sweepstakes is organized by Gurkerl GmbH, Gutheil-Schoder-Gasse 17, 1230 Vienna. To participate in the sweepstakes, it is only necessary to place an order on gurkerl.at between 31.12.2023, 00:00, and 01.01.2024, 00:00.
 

Process of the Sweepstakes
The sweepstakes runs from 31.12.2023, 00:00, to 01.01.2024, 00:00. To participate in the sweepstakes, an order must be placed on gurkerl.at within this timeframe. Participation is automatic by submitting the order. Winners will be notified by email no later than 07.01.2024.
Prizes and Prize Notification
The following prize will be awarded:
Prize: €2,024 in the form of credits for the online shop gurkerl.at (1x).
Winners will be notified by email no later than 07.01.2024. The prize is personal, non-transferable, and cannot be exchanged or collected or paid out in cash. If the winner does not respond within 24 hours of notification, we reserve the right to transfer the prize to another participant.
In the case of multiple orders during the promotional period, the winner will be determined by random selection from all qualified orders. Gurkerl GmbH reserves the right, for data protection reasons, not to provide evidence of the chronological order of orders. The decision on the winner is at our own discretion and is final. We are not obliged to provide evidence of the chronological order of orders to determine the winner.
 

Participation and Eligible Participants
Eligible participants are natural persons who reside in Austria and have reached the age of 18. If a participant is restricted in their legal capacity, the consent of their legal representative is required. Participation in the sweepstakes is only possible in the current delivery areas of Gurkerl GmbH: Vienna and surroundings (more details can be found at www.gurkerl.at). A valid address in the delivery area is a prerequisite for participation. Employees of Gurkerl GmbH and the participating companies, as well as their family members, are excluded from the sweepstakes. Participation using automated data processing and/or through third parties, such as sweepstakes agencies, is also excluded. Furthermore, the operator reserves the right to exclude persons from participation at its own discretion if there are justified reasons, for example (a) in case of manipulations related to access to or execution of the sweepstakes, (b) in case of violations of these participation conditions, (c) in case of unfair behavior, or (d) in case of false or misleading information related to participation in the sweepstakes. Please note that the supplier will independently send the advent calendars. By participating in the sweepstakes, the participant agrees to the respective participation conditions.
 

Termination of the Sweepstakes
Gurkerl GmbH reserves the right to cancel or terminate the sweepstakes at any time without prior notice. The organizer particularly makes use of this option if the proper execution of the sweepstakes cannot be guaranteed for technical or legal reasons. If manipulations are detected in individual cases, e.g., through abusive registrations, the participant will be excluded from the sweepstakes.
 

Data Protection
No new data of the participants will be collected for this sweepstakes. For further information on data protection, we refer to our privacy policy.
 

Applicable Law

Legal recourse is excluded. German law applies, excluding the UN Sales Convention.
 

Severability Clause
Should any provision of these participation conditions be or become invalid in whole or in part, the validity of the remaining participation conditions shall not be affected. Instead of the invalid provision, the legally permissible regulation that comes closest to the economic sense and purpose expressed in the invalid provision shall apply. The same applies in the event of a gap in these participation conditions.
