TERMS AND CONDITIONS FOR THE XTRA MEMBERSHIP SERVICE
This document contains the Terms and Conditions for Xtra Membership ("Terms"). It is a legal document that clearly defines the rights and obligations associated with the use of Xtra Membership. The Xtra Membership is a paid service for customers of the e-shop www.gurkerl.at and offers a range of benefits and perks that enhance your shopping experience.

The e-shop www.gurkerl.at is accessible via the website www.gurkerl.at or the Gurkerl.at mobile app ("Gurkerl.at e-shop").
The e-shop is operated by Gurkerl.at GmbH, headquartered at Gutheil-Schoder-Gasse 17, 1230 Vienna, registered with the Vienna Commercial Court, FN 535948i ("Gurkerl.at").
These terms and conditions are effective as of April 14, 2026.

XTRA MEMBERSHIP SERVICE
Xtra membership is your key to a more convenient, cost-effective, and faster shopping experience in the Gurkerl.at online store. With this service, you’ll have access to a wide range of perks that enhance every purchase—from exclusive discounts to priority shipping and special partner offers.
What benefits does Xtra membership offer?
It offers exclusive discounts and products. With Xtra membership, you get access to special prices and products that aren’t available to regular customers. These include, in particular:
- 10% off select private-label brands such as Miil, Dacello, Moddia, Pappudia, and more
- 10% off organic products marked “BIO” in the e-shop
- Access to an exclusive selection available only to Xtra members.
Delivery benefits. Enjoy convenient, fast, and discounted deliveries with the following benefits:
- Free use of the reusable bag system for Xtra members
Xtra-Free members and Xtra trial members are not eligible for free use of the reusable bag service and must either pay the standard refundable deposit or choose paid delivery in paper bags. You can find details in the Terms of Use for the reusable bag service.
- Free delivery on all orders.
- Guaranteed same-day delivery for orders placed by 5:00 PM.*
- Order 4 times a month with no minimum order value for Xtra members. Xtra-Free and Xtra trial members must meet the standard minimum order value for all orders.

Additional benefits may change over time depending on current offers. You can always find the current list of all Xtra member benefits in the Gurkerl.at online shop. We recommend checking this list before every purchase, as the range of offers is constantly expanding.
Detailed information and terms regarding the benefits of Xtra membership can be found here. Benefits may be offered directly by Gurkerl.at or in collaboration with selected partners. Their availability may vary depending on the delivery location, product selection, or current capacity.
All Xtra membership benefits are renewed at the beginning of each calendar month.
XTRA MEMBERSHIP
Xtra membership is a paid service that opens the door to an even more rewarding and convenient shopping experience at Gurkerl.at. It is available in the following forms:
- Xtra Membership – a subscription-based service available as a paid monthly or annual plan. Xtra members enjoy the full range of Xtra benefits, including no minimum order value and free use of the reusable bag service.
- Xtra-Free – a benefit granted to selected customers as part of promotional campaigns, CRM programs, or other free channels at the discretion of Gurkerl.at. Xtra-Free members enjoy most Xtra benefits; however, free use of the reusable bag service is not included in the Free membership, and all orders must meet the minimum order value specified in the Terms and Conditions.
- Xtra Trial – a free 30-day “Xtra trial period” offered to customers so they can test the Xtra membership service with no obligation. Members of the Xtra trial membership enjoy most Xtra benefits, including exclusive discounts and same-day delivery. However, free use of the reusable bag service is not included in the trial period, and all orders must meet the minimum order value specified in the Terms and Conditions.

To let you try the Xtra membership with no obligation and see if it’s right for you, we’re offering a free 30-day trial.
How does the trial period work?
The free trial period is available to all customers with an active account who have not yet been Xtra trial members. During the trial period, you can enjoy most of the benefits of Xtra membership for free—without making any upfront payment. However, free use of the reusable bag service is not included in the trial period, and all orders must meet the specified minimum order value. At checkout, you can choose whether you want your order delivered in paper bags for a flat fee or in reusable bags for a refundable deposit; see also the Terms and Conditions for the reusable bag service.
How to activate your trial version
Just follow these simple steps:
- You have an active customer account that has not yet had a trial Xtra membership
- Log in via the special Xtra membership page, select the type of membership (monthly or annual), and enter your payment details.
- Only an authorization fee will be charged to verify your card—no money will be withdrawn.
- Once you’ve successfully registered, your 30-day free trial will start automatically
- If you cancel during the trial period, you won’t pay anything (except for a possible deposit for the reusable bags) and will retain the benefits until the end of the trial period.
- If you do not cancel, a fee based on your selected membership plan will be automatically charged after the 30-day period expires
What happens after the trial period ends?
Once the 30-day trial period is over, the service becomes a paid subscription. Fees will be automatically charged according to the plan you selected—until you cancel your membership.
Membership Plans
You can choose between two subscription options:
- Monthly Xtra Membership – with automatic renewal, a monthly billing cycle, and a price of €9.90 incl. VAT
- Annual Xtra Membership – with automatic renewal, an annual billing cycle, and a price of €99.00/year, including VAT.
How to activate Xtra Membership
That depends on whether you're eligible for the free trial:
- If you haven’t been an Xtra member yet, you can activate your membership for free as part of the 30-day trial (see above).
- If you are not eligible for the trial period, simply log in to your customer account, go to the "Xtra Membership" section, select your preferred plan, and complete the payment. Once the payment is successful, your benefits will be activated automatically and immediately.
Payment and Confirmation
After you enter your information, you will be redirected to a secure payment portal where you can pay by card. If you activate the free trial, only an authorization charge will be processed—no money will be deducted.
Once the service has been paid for, you will receive an invoice in accordance with applicable laws. It can be viewed at any time in your order history within your customer profile.
Could activation be temporarily unavailable?
Yes—if there is a significant increase in demand that could affect the quality of the services provided, Gurkerl.at may temporarily suspend new account activations. You will be notified of such restrictions in advance.
CANCEL XTRA MEMBERSHIP
You can cancel your Xtra membership at any time—without giving a reason—directly in your customer account.
If you cancel the service during the trial period, there are no costs. You can enjoy all the benefits of Xtra membership until the end of the 30-day free trial. After that, the service will automatically end.
If you cancel after the trial period ends, you can still cancel at any time. In this case, you will continue to enjoy the benefits until the end of the current paid period, and the subscription will not be renewed.
The membership fee is non-refundable after the trial period, unless you exercise your statutory right of withdrawal (see below).
How to cancel the service

- Or directly in your customer account by deactivating automatic renewal—in this case, the membership will automatically expire at the end of the current billing period
If you cancel the service before the end of the paid period, you are not entitled to a refund (except for the exceptions mentioned).
RIGHT OF WITHDRAWAL
If you have opted for an Xtra membership subscription, you are entitled to a right of withdrawal as a consumer in accordance with statutory provisions.
The right of withdrawal is governed by the provisions set forth in detail in the following
cancellation policy:
a) Right of Withdrawal
The customer has the right to cancel the subscription order within fourteen days without giving any reason. The cancellation period is fourteen days from the day the customer placed the order.
To exercise their right of withdrawal, the customer must notify Gurkerl.at GmbH, Tal 30, Gutheil-Schoder-Gasse 17, 1230 Vienna, email: kunden@gurkerl.at, Phone: 0720 70 4100, of their decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by mail or an email). They may use the attached model withdrawal form for this purpose, but are not required to do so.
To meet the withdrawal deadline, it is sufficient for the consumer to send the notification of exercising the right of withdrawal before the withdrawal period expires.
b) Consequences of withdrawal
If the customer withdraws from this contract, Gurkerl.at must refund all payments received from the customer without delay and no later than fourteen days from the date on which Gurkerl.at received notice of your withdrawal from this contract.
Refunds will generally be made via the same payment method the customer used when placing the order, unless otherwise expressly agreed with the customer. Upon request, the amount may also be credited to the customer’s account in the form of store credit.
Under no circumstances will the customer be charged a fee for this refund.

RESTRICTIONS AND MISUSE OF XTRA MEMBERSHIP
The benefits of Xtra membership are personal, tied to a specific customer account, and non-transferable.
In the event of suspected misuse—for example, repeated sign-ups to obtain multiple trial periods—Gurkerl.at reserves the right to immediately terminate your membership without compensation and block further access to the services.
To use Xtra membership, you must have an active customer account and a valid payment method.
In the event of obvious abuse of the complaint system (e.g., repeated excessive self-claims without valid reason), Gurkerl.at reserves the right to restrict or completely suspend this service—including the right to revoke credits granted based on complaints that are inconsistent with the purpose of the service.
LIABILITY AND WARRANTIES
We offer the Xtra membership service with the utmost care and a commitment to the highest possible quality. However, some circumstances are beyond our control, so the following limitations of liability apply:
We are not liable for:
- The actions of other customers or the manner in which they use the service or e-shop, or other circumstances on their part
- Damage caused by force majeure (e.g., natural disasters, pandemics, government measures)
- Technical failures (e.g., power outages, network issues)
- Suspension or restriction of the Xtra service due to exceptional circumstances or temporary capacity constraints (e.g., due to a health crisis or government measures)
- The content and functionality of third-party advertisements displayed in the Gurkerl.at e-shop
- Unauthorized third-party interference with the e-shop system or misuse thereof
Limited Liability for Third-Party Services
Gurkerl.at is not responsible for the services or actions of third parties that are not part of the organization—whether payment providers, couriers, or other contractual partners. We are not liable for errors or claims arising from their services.
Final Provisions
Legal System, Dispute Resolution
Any use of the Xtra membership service is subject to German law, excluding international private law.
German courts have exclusive jurisdiction over the resolution of disputes. If the customer is a business, the courts at the registered office of Gurkerl.at have exclusive jurisdiction.
Please note that we are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board. Rather, we always strive to resolve any conflicts with our customers ourselves. Please contact our customer service for this as well.
Right to Terminate the Service
Gurkerl.at reserves the right to discontinue the Xtra membership service or the sale of goods and services through the Gurkerl.at shop at any time.
Changes to the Terms
Gurkerl.at may modify or supplement the Xtra membership terms and conditions at any time in a reasonable manner. You will be notified in advance via email or by other appropriate means so that you can review the new version without undue difficulty.
If you do not agree with the changes, you have the right to terminate the contract with one month’s notice, which begins on the day after your notice of termination is delivered to Gurkerl.at.
Severability
If any provision of these terms and conditions is found to be invalid or unenforceable, the validity and enforceability of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by one that most closely reflects the original intent and purpose.

These terms and conditions take effect on April 24, 2025, and were last updated on April 14, 2026.
