GENERAL TERMS AND CONDITIONS – GURKERL REFERRAL PROGRAM


This document contains the general terms and conditions of the Gurkerl referral program ("referral program" or "program"). It concerns a legally valid document that describes the rights and obligations of the Program – a free bonus program for all customers with an active customer account, which rewards the recruitment of new customers on the referrer‘s side with benefits when shopping in the Gurkerl.at e-shop.

Who are we and where can you find us?

The e-shop www.gurkerl.at is available via the website www.gurkerl.at or via the Gurkerl.at mobile app ("Gurkerl.at e-shop").

The Gurkerl.at e-shop is operated by Gurkerl.at GmbH, based at Gutheil-Schoder-Gasse 17, 1230 Vienna, registered at the Vienna Commercial Court under FN 535948i ("Gurkerl.at").

1. GURKERL REFERRAL PROGRAM

The referral program is a free bonus program for all Gurkerl.at customers with an active customer account.

Any customer who has placed at least 10 completed orders in the Gurkerl.at e-shop in the last 12 months is eligible to participate. 

New customers are customers who have not yet placed an order in the Gurkerl.at e-shop.

2. ADVANTAGES OF THE PROGRAM

What are the advantages of using the program for referrers?

  • If you, as a customer, refer a new customer and they place one or more orders in the Gurkerl.at e-shop, you will receive a certain number of credits credited to your customer account for a certain number of orders placed by the new customer within a certain period of time. 


  • One credit corresponds to one euro, and the credits can be used as credit when shopping in the Gurkerl.at e-shop. You can find the number of credits you receive for a completed order by a new customer in the information in the Gurkerl.at e-shop or your customer account, the current advertisement by email, or on social media.


  • The credits are non-transferable and valid for a period of 2 months after receipt. A payout in the amount of the corresponding cash value is excluded.


  • An order is completed when the order has been delivered and paid for.


Gurkerl.at reserves the right to change, supplement, or temporarily restrict the benefits, in which case customers will be informed in an appropriate manner.

3. HOW YOU CAN PARTICIPATE

Here's how you can participate in the referral program:

Step 1: Register as a customer

First, register in the Gurkerl online shop at www.gurkerl.at. You can

  • easily register online via the website or the mobile app.


If necessary, you can also call our free customer service hotline at 0720 70 4100, where our team will be happy to help you.

To register, you will need the following information: your name, address, phone number, and email address.

Existing customers are automatically enrolled in the program as soon as they meet the eligibility requirements. However, participation only begins after the customer has agreed to the program terms and conditions (before using a referral link for the first time). Customers can opt out of such enrollment.

Step 2: Place 10 orders within 12 months

To participate in the referral program, you must place 10 completed orders within 12 months. Once you have placed 10 completed orders within 12 months, you can participate in the referral program immediately after completing the last order.


Step 3: Send the invitation link to one or more new customers

Eligible customers receive a personal referral link that they can send to friends, etc. via appropriate channels. You can find this link and further information in your customer account and on the program website. 

Step 4: The new customer places at least one order after receiving the invitation

As soon as the new customer places at least one order after receiving the invitation, you will receive the specified number of credits in your customer account. This credit is automatically added to your account. 

If the new customer places 1 or 2 additional orders within 30 days of the only just placed order, you will also receive the specified number of credits for these additional orders after each order has been completed. Any further orders beyond this are no longer eligible for participation in the referral program.

If the minimum order value for the three aforementioned orders differs from our usual minimum order value, you will find this information in the general information about this program (e.g., on the program website).

4. ABUSE OF THE PROGRAM

Prohibition of abuse

Opening multiple accounts with the aim of enjoying the benefits of the referral program multiple times, even though the customer behind the accounts is identical, is prohibited. This applies to both referrers and new customers.

The use of fake identities or the exploitation of technical loopholes to obtain benefits that would not be possible with proper use is also prohibited.

The use of automated systems to generate referrals is not permitted. 

Penalties for misuse

In the event of suspected abuse/proven abuse, Gurkerl.at reserves the right to:

  • block the use of the referral link for a certain period of time,


  • to immediately terminate the customer account(s) without paying out any benefits, and


  • demand compensation for damages caused by the misuse.


5. DATA PROTECTION

Personal data of new customers will not be disclosed to the referrer. The referrer will only receive information that the referral link has been activated; the new customer will not be identified.

To prevent fraud and verify eligibility for the referral program, the phone numbers of both the referrer and the new customer, device fingerprints, and the IP address of the respective device are checked.

Notifications about participation levels achieved and status changes within the program are sent by email, push notification, or SMS. The relevant information can also be accessed in the customer account and on the program website.

6. LIABILITY AND WARRANTY

We operate the program with the utmost care and strive for the highest quality. However, there are circumstances beyond our control:

Gurkerl.at is not liable for:

  • violations of data protection regulations by advertisers that may arise from forwarding the invitation to potential new customers


  • actions of other customers or circumstances arising on their part


  • damage caused by force majeure (natural disasters, epidemics, government decisions, etc.)


  • technical failures (power outages, network disruptions),


  • interruptions or restrictions to program services due to extraordinary events,


  • the content and operation of third-party advertising in the Gurkerl.at e-shop


  • unauthorized interference by third parties in the e-shop system.


Limitation of liability for third-party services

Gurkerl.at is not responsible for the services of payment service providers, couriers, or other contractual partners. We are not liable for errors or failures on the part of third parties.

7. FINAL PROVISIONS

Legal framework

This legal relationship is subject to German law, excluding international private law. The place of jurisdiction is agreed to be the registered office of Gurkerl.at, insofar as this is permissible.

Relationship to other terms and conditions

In addition to these General Terms and Conditions – Gurkerl Referral Program, the General Terms and Conditions of Gurkerl.at also apply, which can be viewed at www.gurkerl.at. In the event of contradictions, these terms and conditions shall take precedence.

Termination of the service

Gurkerl.at may terminate the Gurkerl Referral Program or the sale of goods and services via the Gurkerl.at online shop at any time.

Changes to the terms and conditions

Gurkerl.at may change or update these terms at its sole discretion. You will be notified in advance of any changes by email or other appropriate means, provided that you have already qualified for the referral program.

Severability

Should any provision of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that comes closest to the original meaning and purpose.
